Chicago Driver's License Attorney for Lifetime Revocations

Lifetime Revocation - Upcoming Opportunity for Changes in State Law

Any person who has had 4 or more DUI convictions will have his or her driver's license revoked for life. If you are in this position, there are specific legal actions that could be taken to allow you to regain your legal right to operate a vehicle in the state. There are specific forms of relief that could be possible. Under House Bill HB1568, it was proposed that after 3 years that these people could have the opportunity to gain a restricted license, and there many of us hoped that this bill would pass.

The Fight for Justice for Law Abiding Citizens that have a Permanently Revoked License

Unfortunately, that bill lost, but legal actions are continuing to help those who had a license permanently revoked, but who have lived a law-abiding life for many years and are no longer a threat to society due to alcohol or drug intoxication. As HB 1568 was not successful and lost in a vote, the situation currently remains difficult to resolve. However, the actions continue to address this important issue, with a new bill presented to the state legislature on this matter. The current bill is HB4206, and should this bill make it through the legislature successfully, there is hope for those who have had their driver's license permanently revoked, but are now clean and sober and are seeking driver's license reinstatement. The bill is now in the Rules Committee, and continues to advance through the process, offering hope to many who have lost their ability to legally operate a vehicle in the state due to permanent revocation.

Under the new bill, certain parties will gain the right to have a restricted driving permit when there is clear and convincing evidence of 3 years of sobriety, with neither drug nor alcohol use, and the requirement that the person has completed the drug or alcohol rehabilitation program by a properly licensed rehabilitation service. The proposed law further states that those who, upon gaining this restricted permit, and having the requirements met, including the installation of an ignition interlock device, once again violates the law, that person will have absolutely no opportunity to gain the legal right to drive in the state, with revocation permanent.
