What Constitutes Criminal Sexual Assault in Illinois?

In Illinois State law, someone who has submitted another to a sexual act of any kind without legal consent has committed sexual assault. These acts are often referred to as rape, molestation, fondling groping, any other kind of touching, or any other form of sexual act and are codified under the Illinois Criminal Sexual Assault Statute at 720 ILCS 5/11-1.20. Even if there is no force involved with the behaviour, it could be considered sexual assault if the alleged victim had no means of giving proper consent, such as in cases involving minors or mentally disabled persons. In order to sustain conviction for Criminal Sexual Assault, prosecutor must prove, sexual penetration and one or more of the following elements.

  • uses force or threat of force
  • knows that the victim is unable to understand the nature of the act or is unable to give knowing consent
  • is a family member of the victim, and the victim is under 18 years of age
  • is 17 years of age or over and holds a position of trust, authority, or supervision in relation to the victim, and the victim is at least 13 years of age but under 18 years of age

Consequences of Criminal Sexual Assault Accusations

In many cases, sexual assault charges are considered Class 1 Felonies. Penalties surrounding this serious sex crime can be absolutely devastating to the accused, taking away their freedom and livelihood for stretches at a time, if not the rest of their life. If violence was used against the alleged victim, the consequences could be even worse.
